1. Certification. Each business and each owner/officer signing below (individually and collectively, "you") certifies that all information and documents submitted in connection with this application are true, correct and complete, and that you are authorized to sign on behalf of the business. You agree to promptly notify Prime Trades Funding of any material change in the information provided. Submission of this application does not mean that Prime Trades Funding will provide any financing or financial services whatsoever.
2. Business Purpose Only. You represent that any financing requested is for business or commercial purposes only and not for personal, family or household purposes.
3. Authorization to Obtain Information. You authorize Prime Trades Funding, operated by E&R Capital LLC ("PTF"), and each of its agents, representatives, successors, assigns, designees, and the funders, lenders and investors it works with to obtain consumer or personal, business and investigative reports and other information about you, including credit card processor statements and bank statements, from one or more consumer reporting agencies, such as TransUnion, Experian and Equifax, and from other credit bureaus, banks, creditors and other third parties. You also authorize PTF to transmit this application form, along with any of the foregoing information obtained in connection with this application, to any or all of the funders, lenders and investors it works with for the foregoing purposes. You also consent to the release, by any creditor or financial institution, of any information relating to any of you, to PTF and to each of the funders, lenders and investors it works with, on its own behalf.
4. Authorization to Share. You authorize PTF to share the information collected in connection with this application, including credit reports and other information obtained about you, with its funders, lenders, investors, and other third-party financial institutions for the purpose of evaluating your application for financing.
5. Broker Disclosure. You acknowledge that PTF is a broker and not a direct lender. PTF may receive compensation from funding partners for placing your application. This compensation does not affect the terms of any financing offered to you.
6. Consent to Calls / Texts / Emails. You authorize PTF and its agents to contact you regarding your application using any phone number or email address you have provided, including through automated telephone calls, text messages, and emails, even if your number is on a Do Not Call list. Standard message and data rates may apply. Reply STOP to opt out of text messages and HELP for assistance.
7. Electronic Signatures & Records. You agree that your electronic signature and the electronic records of this application have the same legal validity and enforceability as handwritten signatures and paper records. You acknowledge that you are signing this agreement electronically and consent to receive electronic records.
8. Duration & Privacy. This authorization remains in effect for the duration of your business relationship with PTF and any funding partner, and may be revoked only in writing. Information collected will be handled in accordance with PTF's Privacy Policy, available at primetradesfund.com/privacy-policy.
